    Should safety commision reports be used in criminal cases?

    I have just read on Air Transport Intelligence that the captain of the Garuda Indonesia Boeing 737-400 that crashed last year (killing 21 people) has been charged for manslaughter!

    The report last year said that the pilot was fixated with landing the aircraft, ignoring calls from the co-pilot to go-around , but what is interesting is whether the report should be submitted in criminal cases.

    Can we ever know fully (and can the report conclusively state) whether an accident has been caused and solely caused by a captain's negligence. If so, should it be used in all cases?

    I would say that in this case the pilot's actions seemed pretty reckless and so some sort of charges were due, but i am not sure (or know) whether this should be applied to all cases?
