LEGAL INTELLIGENCE Mr. J. A. WhiteheadAT the London Bankruptcy Court, on October 29, Mr. J. D. Turner, the Official Receiver for Surrey, presidedover the statutory meeting of the creditors in the failure of Mr. John Alexander Whitehead, of Han worth Park House,Feltham. The statement of affairs showed total liabilities of £85,693, of which £23,283 rank for dividend, againstassets estimated to produce £14,720. Mr. Turner explained that in May, 1915, the debtor formedthe Whitehead Aircraft Company, Ltd., with a nominal capital of £5,000. In the following year this concern wastaken over by the Whitehead Aviation Company, Ltd., formed with a capital of £250,000, and that in turn wasabsorbed by the Wbitehead Aircraft (1917), Ltd., of which the debtor became governing director. On the terminationof the War a post-War programme was arranged by the company, which, however, it was unable to carry out owingto the company's not receiving from the Government that money which it considered it was entitled to, and there wasnow a claim by the company outstanding against the Govern- ment of £449,305. The company ultimately went intovoluntary liquidation, and the debtor found himself faced with contingent liabilities for a considerable amount onguarantees which he had given to shareholders and creditors of the company. To that cause and to the present financialposition of the Whitehead Aircraft (1917) Company, Ltd., he attributed his present failure. The meeting passed a resolution appointing a trustee toadminister the estate. The Aeronautical InstituteAT BOW Street Police Court on October 27, before Sir Charles Biron, a summons, issued at the instance of theBoard of Trade, was heard against Lucien Blin Desbleds and Colonel Frederick Natusch Maude, C.B., for carrying onbusiness as the Aeronautical Institute of Great Britain at Lincoln's Inn Fields without having furnished particulars asrequired by the Registration of Business Names Act, 1916. Mr. Burrows, for the Board of Trade, said that the nameof the institute sounded as though it was some learned society, but it was suggested that the concern consisted ofthe two defendants alone, and that it was run with a view to profit, although no profits appeared to have been made.It was formed at a meeting, with Sir William Ramsay in the chair, in June, 1915. Some very distinguished peopleallowed their names to be put on a council or committee, • and M. Desbleds was appointed director and Colonel Mauderecorder. The defendants appeared to be the only two persons who now had anything to do with the concern, all the othersupporters having died or resigned. The institute issued a publication called Air, which was on sale to the public, andalso advertised some educational scheme, and demobilised soldiers were invited to attend for instruction and training inaeronautics, the fee for the course being £5 55. The attention of the Board of Trade was called to the concern in June, 1919,by a creditor, who wished to discover who ought to be sued for the recovery of a debt. M. Desbleds said that the institute had never been carriedon for profit, and if any had been made it would have been devoted to the objects of the institute.The Magistrate said it appeared to him as though this was one of those rather visionary schemes which originated.during the War. He adjourned the summons to consider whether the defendants had any case to answer.
