British Airways is said to be the subject of a US class-action lawsuit by Washington firm Cohen, Milstein, Hausfeld & Toll (CMH&T), drawn up in the wake of the investigation into alleged price-fixing on long-haul routes.

The suit was filed on 23 June in New York, according to business daily newspaper Financial Times.

It alleges that BA colluded with Virgin Atlantic on its fuel surcharges on key transatlantic routes. Virgin Atlantic has been aiding the UK Office of Fair Trading investigation which has focused on BA.

BA declines to comment on the development, but says: “We are still in a position where we are unable to say anything further to the statement issued [on 22 June].”

CMH&T is also pursuing class-action suits following a probe into alleged cargo fuel surcharge collusion between airlines, which emerged earlier this year.
